The following terms and conditions are intended to be fair to all parties concerned and to aid in the supply of services. This agreement represents the complete agreement and understanding between Designsense Internet Marketing and the account holder/client.
Due to our high standard of our Internet Marketing we have the confidence to guarantee all our website designs by 100%. During the whole process of your project, you will have access to your website and are encourageed to provide feedback at all times. If at any time you are not totally satisfied with your websites design or functionality, we will make the neccesary adjustments and continue to work on your website until we have exceeded your expectations. We beleive that you should be totaly satisfied with the final result. We can't be any fairer than that. We take pride in all our satisfied customers and look forward to giving you the same level of service excellence.
Pricing of all Internet Marketing projects are based on the discussion, features and requirements to your business. If during the construction of your website other ideas come to mind, these will need to be discussed and a new quotation provided. For this reason it is important that have a clear vision of what your website will need.
All new Internet Marketing projects require a deposit to be paid before commencement, a progress payment as your webite is being developed and the ballance upon completion. The following is an example of your payemnt options which may be adjusted to suit your needs.
To avoid deadlines, Designsense Internet Marketing beleives in working together with the client in a timely manner. The client should supply Designsense Internet Marketing with any specific text, graphics, or other specific items for inclusion in a timely manner, unless agreed otherwise. The following lead-times can be expected.
Text / Copy may be submitted on CD, DVD, Memory Stick or emailed to Designsense Website Design in standard Microsoft Word format. Unless agreed upon, modification of your text or creating copy for your website is not included in most of or packages. If you feel that providing text may be an issue, please discuss this with us prior to commencement.
Photos & Graphics should be off the highest quality possible and may be submitted on CD, DVD, Memory Stick or emailed to Designsense Website Design in any of the standard graphic formats. These include;
Website hosting & domain name registration will be purchased on behalf of client through our partner netregistry.com.au. Website hosting & domain name registration will be for a period of one calendar year from time of purchase. Designsense Website Design will register clients name and address as the administrative contact/owner of domain. After completion of first year it is the clients responsibility to renew their contract with netregistry.com.au. Warning of account expiry will be sent via email to client from netregistry.com.au, 1 month before its expiry date. It is the clients responsibility to comply with netregistry.com.au policies.
(If Applicable) In order for the client to accept online payments, the client is responsible to signup with PayPal.com (no signup fee) to accept online credit card orders. There are no setup charges, monthly charges, or gateway fees. With PayPal, you pay as you go with rates as low as 1.1% to 2.4% $0.30 AUD per transaction. In fact, payment processing, fraud protection, and tools to accept payments on your website are all included in PayPal’s costs.

The Client will obtain all the necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks or any other material supplied by client. The client represents to Designsense Website Design and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Designsense Website Design for inclusion in web pages are owned by the client, or that The client has permission from the rightful owner to use each of these elements. And will hold harmless, protect, and defend Designsense Website Design and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.
A link to Designsense Website Design will appear in small type at the bottom of your website. The link will not cause users to leave the clients website, rather, it will open a new browser window to the Designsense Website Designs website, at Designsense Website Designs discretion. The link will typically state, "Design by Designsense Website Design." This link may not be modified at any time without express written consent of Designsense Website Design during the existence of the website for public viewing.
Designsense Website Design cannot accept responsibility for any alterations caused by the client or third party developers occurring to the clients web pages once placed. Such alterations include, but are not limited to additions, modifications, deletions, stolen content, stolen domain name or hosting failure.
While Designsense Website Design shall use its iniciative to ensure that backup copies of your website and all data contained in the website are made at the time of publishing, the client is responsible for backup of such data and Designsense Website Design shall not be liable for any damages, loss, costs or other expenses arising out of or in connection with any loss of data by the client which are due to the failure of the client or Designsense Website Design, or its partners to back up such data after the websites completion. For those who would like their data backed up on a monthly or quartely basis, a per backup fee of $44.95 applies.
Neither Designsense Website Design nor anyone else who has been involved in the creation, production, or delivery of the website shall be liable to the client or any third party for any direct, indirect, special, consequential, or incidental damages (including but not limited to damages for the loss of profits or savings, downtime, business interruption, loss of business information, damage to or replacement of equipment and property, recovery or replacement of programs or data, or other pecuniary loss) arising out of the use, the results of use, or inability to use the website services, even if Designsense Website Design has been advised of the possibility of such damages or claim. In any case, Designsense Website Designs entire liability under any provision of this Agreement is limited to the pro rated amount actually paid by client for the website.
This Agreement is governed by the laws of Australia. If for any reason a court of competent jurisdiction finds any provision of this license, or portion thereof, to be unenforceable, that provision of the license shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this license shall continue in full force and effect. Each of the parties hereto irrevocably attorns to the jurisdiction of the courts of Australia and further agrees to commence any litigation which may arise hereunder in the courts located in Australia.
By placing a order for Designsense Website Design services acknowledges that you have read this Agreement, understand it, and agree to be bound by its terms and conditions, and you further agree that this Agreement is the complete and exclusive statement of agreement between the parties and that it supercedes all proposals or prior agreements, oral or written, and any other communications between the parties relating to the subject matter of this Agreement.
